Ellis will face a three-day trial starting on Tuesday, May 27, because of the May Bank Holiday, where it was placed on the warned list, meaning it could be called on at any time that week.
Judge Anthony Lowe told him: “This matter will have to be decided by a jury but that won’t be until next year.”
Ellis was given conditional bail.
